見到草行媒啱啱出左篇文,提到打工仔女碰倒因被罷工而俾老闆扣人工嘅問題,諗起呢排好多
人都喺度諗緊同講緊攪罷工、攪工會,咁我其實都有喺度諗緊呢樣嘢,同都搵左唔少料睇,同
好似見倒有啲部份暫時都唔多覺有好多朋友提及,所以啲起心肝投個稿俾草行媒同大家分享下
,希望草行媒編輯可以採用同登出嚟啦。

首先,講下法例。如果仔細睇下啲關事嘅法例。比如《僱傭條例》裡面關於罷工嘅解釋、職工
會唔受歧視嘅保障、打工仔女參加職工會同埋職工會活動嘅權利、打工仔女享有僱傭保障嘅權
利。《職工會條例》裡面關於職工會嘅權利與法律責任。(甲)

再噒下佢哋,你就會發覺原來法例上雖然有保障打工仔女罷工嘅權利。但係呢啲保障淨係會保
障因為勞資糾紛攪嘅罷工。重要果啲甚麼保障都只係保障你如果因為呢啲罷工而俾老闆炒,咁
就係老闆唔啱,要賠償。如果想要點復職,好似都唔係唔可能,不過應該都幾難。同埋如果老
闆真係有心要炒你,使乜咁煩呀!是但講個原因都可以終止合約啦。

咁即係話,大家呢排講緊諗緊嘅攪工會攪罷工,放個核彈攬炒政府,其實係喺法例上係一啲保
障都冇嘅!咁但係,睇住個政府咁仆街,罷唔倒工,炒佢唔起,條氣又真係唔順。咁點算好呢
?係唔係真係冇計呢?都明嘅,對啲自己食自己嘅月光族或者啲有家累嘅打工仔女來講,冇左
份工又真係好難攪同好令人擔心嘅。不過條氣又真係頂唔緊,哽唔落。點算好呢!?

諗起草行媒之前篇文提到嘅勞工組,我之前都有聽過佢哋嘅分享。佢哋嘅組合並唔係慣常聽得
多嘅行業或者企業工會,佢哋嘅成員係喺唔同嘅企業,唔同嘅行業打工嘅。而佢哋嘅做法,好
似係同遇倒問題嘅打工仔女了解清楚情況之後,就會俾意見同鼓勵啲打工仔女點樣自己去直接
同老闆傾同爭取應有嘅權益。如果都攪唔掂,佢哋就會動員啲成員一齊去遇倒問題嘅打工仔女
返工嘅公司或者舖頭,直接俾壓力個老闆,迫佢同佢哋坐低傾。咁諗落,如果大家真係唔好彩
,因為法例唔保障嘅罷工俾老闆攪嘅話,搵佢哋幫手一齊砌,可能都重會有啲揸拿,唔一定輸
喎!同埋勞工組佢哋好似重攪埋個會員每月供款嘅內部罷工基金嚟支援因罷工而出現經濟困難
嘅會員添喎。

再加上,如果大家有留意而家時不時都聽倒有啲舖頭會藍扮黃,其實咁即係話大家齊心同持續
嘅罷對啲生意佬其實係有可能有啲力,會迫倒佢哋有反應嗰喎。咁大家如果真係可以走埋一齊
,一方有事,八方支援,齊上齊落,咪有機會可以幫倒啲俾啲仆街老闆攪嘅打工仔女囉。
呢種工運抗爭模式,如果資訊攪得好,同大家真係肯出來,應該有得攪喎。咁咪即使傳統行業
或者企業工會因為法例限制而未必攪倒嘅問題(乙),都有機會可以靠大家齊上齊落、be
water而有得砌囉!咁啲未必咁容易罷倒工嘅打工仔女咪可以多啲信心出來齊上齊落囉!雖然唔
可以話零風險,但都應該有得砌掛。正所謂砌就有機會贏,唔砌就輸一世喎。同埋即使真係砌
唔掂,大家夾埋個罷工基金,幫手頂住先,再一齊幫手搵過個良心老闆囉。

2. 釋義
“罷工” (strike)指一群受僱用的人經共同協定而停止工作,或任何數目的受僱用的人因發生糾紛
而一致拒絕、或經達成共識而拒絕繼續為某僱主工作,作為迫使他們的僱主、另一人或另一群
人的僱主,或任何受僱的人或一群受僱的人,接受或不接受僱傭條款或條件或影響僱傭的條款
或條件的方法;
第VII部

46. 和平糾察
即使本條例另有規定,如一個或一個以上的人代表其本人,或代表任何已登記職工會或代表任
何個別僱主或商號,為籌劃或深化勞資糾紛而出現於或臨近任何人工作或營業的地方,目的僅
是為和平地取得或傳達訊息,或和平地勸說他人工作或不工作,則屬合法︰
但如他們如此出現因人數或因有關方式而屬刻意對該地方的任何人造成恐嚇,或妨礙出入,或
致使社會安寧被破壞,則屬不合法;任何人違反本但書,即屬犯罪,循簡易程序定罪後,可處
罰款$1,000及監禁6個月。

(乙)呢度唔係想話啲工會做唔倒嘢。大家要明白同體諒,佢哋係需要根據香港而家啲法例嘅
要求,去組織打工仔女,去登記成立工會,先可以就住法例嘅保障同大家去爭取。呢啲其實係
法例嘅限制,而唔係工會嘅限制囉。如果大家可以先為自己直接嘅權益組織工會,打好個底氣
,再自發主動行多兩步,為大家可能冇咁直接但其實都好影響緊大家嘅議題投入多啲,了解差
異,尋求共同,聯網聯盟,齊上齊落,咁真係會有機會罷乜都有力㗎!

On November 10, we will host events throughout the day in Chater Road. Speeches, solidarity messages, and an action-packed day of cultural presentations will be carried out by various LGBTQ+ and women migrants’ groups and organizations.

There will be a ‘Dance for a Cause’ challenge, singing, face painting, and free shirt printing. There will be a photo exhibit and an information desk for those who are seeking to learn more about our initiatives.

Highlight of the event will be the Migrants’ Pride Parade. Route of the parade will be from Edinburgh Place (City Hall) to major points of the Filipino community in Central before going back to the venue for the main program.

Migrants’ Pride Parade should be festive and colorful. Each section of the parade will be designated with rainbow colors.

This year, Migrants’ Pride will also launch its build-up activities on our campaign to educate the community on issues of LGBTQ+:

  1. Migrants’ Pride will continue reaching out to LGBTQ+ migrants communities through a survey among lesbians and transgenders on their employment conditions and concerns of LGBTQ+;
  2. LGBTQ+ Forum and Film Showing, “Lesbian Factory”; and
  3. Pride Hour every Sunday, an awareness campaign in the community for Migrants Pride.

在港LGBT移工社群於第五屆移工嬌傲日要求落實生活工資及LGBT權益

Migrant LGBT organizations in Hong Kong, supporters from local groups, and other migrants organizations gathered 1st of September with high spirits for their upcoming Migrants Pride March on 10 November 2019 in Chater Road, Central with the theme ‘Pride is for Living Wage, Rise with Pride for Change!’

在港LGBT移工團體,其他本地及移工團體於九月一日充滿鬥志地宣佈,以「嬌傲地爭取生活工資、嬌傲地起來帶來轉變」為題的第五屆移工嬌傲日,將在2019年11月10日於中環遮打道舉行。

 

Now on its fifth year, HK Migrants Pride will be launching events for education and campaigns to raise awareness on calls and concerns of the LGBT community. Last Sunday, September 1, the organizers kicked off the celebration through conducting an LGBT survey to determine their working conditions and LGBT concerns. Also, there will be a “Pride Hour” at 3pm every Sunday starting on October 6 in major converging points of migrant communities. LGBT migrants will also join the September 15 rally on wage. LGBT migrants are some of the active participants in the fight for living wage and better living conditions.

到了第五年,香港移工嬌傲日將舉辦多項宣傳教育及行動提昇對LGBT社群的需求的意識。上星期日,即9月1日,移工嬌傲日開始進行了解LGBT移工的勞動條件及需求。另外,10月6日開始,在移工社群的主要聚集地點,將在逢星期日的下午3時舉行嬌傲時刻的活動。LGBT移工亦會參與9月15日,要求增加工資的遊行。LGBT移工同時是爭取生活工資及改善生活條件的積極參與者。

 

With this year’s theme, HK Migrants Pride aims to highlight migrant domestic workers’ call for living wage and changing social concerns that perpetuates discrimination and exclusion in society, according to the organizers.

據組織者們分享,就今年度的主題,香港移工嬌傲日希望突出移民家務工爭取生活工資的訴求,及改變社會上歧視及社會性排拒的狀況。

 

‘With 380,000 migrant domestic workers (MDWs), it was never clear how the minimum allowable wage (MAW) was reviewed and implemented every year despite efforts of the Asian Migrants’ Coordinating Body on their calls for transparency on the calculation of wage. MDWs who are playing a major role in HK economy, and each and every household we serve, are among the lowest earners. Aside from that, many of them work 24/7 and are not ensured decent accommodation. It is high time to call for living wage, a significant wage hike (HK$5894) and transparency of its computation’, said Shiela Tebia-Bonifacio of Gabriela Hong Kong and one of HK Migrants Pride organizers.

香港移工嬌傲日其中一位組織者,Gabriela Hong Kong 的Shiela Tebia-Bonifacio 提出,就有約380,000人口的移民家務工(移工)來說,即使亞洲移住人士聯盟不斷地要求需公開及透明化處理她們的最低可接受工資的計算及調整機制,但始終未獲得政府正面回應。移工們除了對香港經濟有所貢獻外,更服務了許多家庭的需要,但她們卻是最低收入的勞動者之一。除此以外,她們許多都需要每天二十四小時、每周七天候命,及沒有得到合理的住宿休息空間。現在正是恰當時刻去爭取生活工資,及顯著地調升工資(港圓5,894)及公開該調整機制。

 

Nick Delfin, another organizer from Filipino Lesbians Organization or FILO, added that exclusion of MDWs from important labour laws such as the Statutory Minimum Wage put all MDWs, including LGBT migrants, in a condition vulnerable to abuses and exploitation.

另一位組織者, Filipino Lesbians Organization(FILO)的 Nick Delfin補充了,把移工排除於如法定最低工資的重要勞工保障之外,是把包括LGBT移工的整體移工置於一個易受侵犯及剝削的處境。

 

‘This vulnerability is doubled among us LGBT migrants as we face discrimination and stereotypes that impact our work and living conditions’, Delfin remarked.

Delfin更指出,這種易受侵犯的情況尤以LGBT移工為甚,她們同時需面對社會上的歧視及刻板印象對她們的工作及生活條件的影響。

 

‘Together, we are PRIDE! We demand living wage and we continue our fight to end discrimination and social exclusion! We still have a lot to struggle as LGBT migrants, but is only through our collective action that we will reach our aspirations’, Delfin said.

Delfin說,我們是嬌傲自豪的!我們要爭取生活工資,及我們會持續爭取去結束歧視及社會性排拒!身為LGBT移工,前面我們仍有很多需要爭取的,只有透過連合行動,我們才可達到我們的期望。

以下為清潔工人職工會就行政長官會見記者時點名要求食環署清理「連儂牆」一事致特首及食環署的公開信。

勿假借清潔之名剷走民意 勿將清潔工人做磨心

早前(10月29日)行政長官林鄭月娥出席行政會議前會見記者時點名要求食環署清理「連儂牆」,參與「止暴制亂」。

間接下令外判清潔工人剷去牆上民意

反對修訂逃犯條例的風波持續,各區出現多處「連儂牆」,市民自發貼上字條、標語、海報等表達訴求。政府要求食環署前線清潔工人清理「連儂牆」無疑將前線工人置於市民與政府之間,激起前線工人與市民對立。

據清潔工人反映,現時每次在警方施放催淚彈後,滿街的物件都是由外判清潔工人清理,對工人而言其實是額外工作。即使障礙物殘留催淚煙或胡椒噴劑、在沒有任何額外裝備的情況下,清潔工人都盡責地在清晨時分進行清理。

至於貼在「連儂牆」上的字句標語並不是垃圾,亦非一般宣傳街招,而是市民的意見與看法。

假借清潔工人之手剷走民意

本會(清潔工人職工會)認為,「連儂牆」出現源於人民對政府的不滿,是一種和平民主的表達方法。政府聆聽與否,應直接向市民交待,決不可假借清潔工人之手剷走民意,令清潔工人成為磨心。事實上有工人反映,如旺角區清潔工人曾因應食環署及外判公司要求,清理天橋上文宣及海報,因而遭到路過街坊市民的非議及責難。

清潔工人是社會最基層無聲默默工作的一群,在近幾個月的社會行動和警方催淚彈下,都默默盡責地工作;既受老闆指令,也受食環處監管。工會呼籲清潔外判公司,不要為求保住合約而迫令工人剷去「連儂牆」。

政治問題應政治解決,清理「連儂牆」並無助「止暴制亂」,政府須積極回應市民訴求,不要假借清潔工之手剷走民意。
