五一遊行:移民家務工

印尼家務工關注團體,印尼家務工要求取消印尼2004年39號法例聯網(Network of Indonesian Migrant Workers to Scrap Law No 39/2004, JBMI)於五月一日國 際勞 動節進行集會遊行,希望藉是次活動喚起香港社會大眾對移民家務工的關注。她們早上於維園足球場集合,透過唱歌、跳舞、話劇表演等 各種方式向其他印尼姐妹表達她們應享有卻被忽視及剝奪的基本權利。約下午一時,組織聯同其他印尼團體出發遊行到印尼領事館,期間她們高舉「End Slavery」橫額及高呼「We are workers. We are not slaves.」,直呼對印尼及香港政府漠視多項剝削政策,縱容僱主及中介公司無良 對待 的不滿。遊行完結後,ATKI回到維園會合其他本地勞工團體出 發遊行到政府總部。大隊抵達政府總部後,各個團體分別派出代表演說,共同捍衛勞工權利,為在社會上不同長工時勞工,包括印尼家務工,表達訴求。

是次遊行主要對香港及印尼政府表達六大訴求︰

一.團體要求香港政府將印尼家務工的最低工資調高至四千五百元的合理水平,及把移民家務工涵蓋在最低工資保障法例之內。
二.廢除完成合約後只兩星期逗留的規定以及其他針對移民家務工的岐視性簽證措施。
三.廢除移民家務工必須於僱主家中住宿的規定,容許僱傭雙方自行協商「內宿」或「外宿」的安排。
四.訂定所有勞工享有的標準工時,同時包括移民家務工在有關保障之內。
五.對中介公司侵犯移民家務工權利及非法的手段,採取有效的打擊措施。
六.確認國際勞工組織所訂立,為保障家務工生活及勞動條件的基本人權標準的C189號 公約。

這些問題的癥結,源於兩地政府的縱容及政策。由於印尼政府規定出口外勞必須經中介公司找工作,令中介公司可以從中謀取暴利,甚至「食兩家茶禮」。印尼政府規定所有到海外工作的勞工必須購買無理的保險(條例只適用於 印尼境內),壓榨移工。香港政府雖有法例監管,但疏於執行亦進 一步助長剝奪問題惡化。孤立無援的印尼姐妹唯一的出路,難道只有靠自己?

接受訪問的印尼家務工均相信唯有更多的姐妹團結站出來一同發聲,她們才有希望帶來改變,脫離被無理剝削的處境。即使新聞揭露不少姐妹被僱主暴力對待,她們仍然呼籲同伴友善對待僱主,只因她們相信不少僱主都不太差。

對於香港人,印尼姐妹們首要希望他們能夠對於這班為香港經濟默默奉獻的人有更多不同層面的認識。 她們希望從香港人身上得到的是一個建基於人與人之間存在著的平等對待。她們希望這些關注不僅只在印尼家務工,從其他地方移居 香港的家務工亦應得到同樣的尊重。

關 注移民家務工議題的加拿大籍學者認為,移民工被剝削的問題雖不僅只存在於香港,但香港人有責任去了解這些以他們家作為工作地方的幫工。他們相信這些姐妹能夠照顧他們的家庭,所以相對應地給予她們應有的尊重。另一方面,香港政府應該賦予應有的權利,例如作出投訴和表達訴求的權利、住宿安排的選擇等等。同時,印尼政府應該反思國民為何於本國缺少發展機會;對於出外工作的人民,政府應確保他們被尊重,以及有真正的選擇,而不是「被逼」的選擇。

訪問後感

移民家務工人在港因為國籍、身份、文化差異等各種原因,本來在港生活已需要面對一定程度上的困難,再受到自己國家和前往工作的國家所訂下的各項條例剝削,導致她們心理及生理上都面對著嚴峻的挑戰。身在異鄉,長期受到壓抑的她們只能啞忍著這一切的暴力。在社會上,莫說表達訴求,甚至對自己最基本的權利也模糊不清,更 缺乏勇氣去處理這些由內至外產生的壓抑。遊行及訪問過後,我發現了她們所追求的其實很簡單,和姐妹一起分享、遊行、連結大家 的力量、被香港人尊重及聆聽.已能展開笑顏和感到知足。在物質主義發達的香港社會下,港人擁有很多外在的享受,盲目地追求更 高質素的生活水平。可是,人民的素質卻逐漸下降,失去了對別人的包容、同理心、尊重等,大部分人都著重眼前的東西卻遺忘了人 性的本質。對著移民家務工人,更會採取各種行為的歧視,而姊妹在受到歧視下仍然選擇相信這裏不是每個人也同樣惡劣地對待她 們,我看到了她們的美善。她們漂流海外、與家人分開、走到別人的家庭裏工作、誠懇的服待著,有誰能輕易理解這種情況下的所承 受的辛酸和思念家人的滋味?假若有天你到海外工作時,別人把你當作奴隸般對待而非人性對待,你又有何感受?回到本質,將心比己,撿回自己的冷漠,重新審視這群默默地奉獻的人,思考她們的付出與社會大眾那密不可分的位置,關係。她們也是我們的一分子,沒有她們的付出,繁忙的香港人又怎能埋頭工作而撇下家務事於不顧?

很多「命生得好」的人為了繼續活在美好的想像中,都選擇了忽視身邊不公的事。這些美好的想像或許永遠都不會幻滅,又或者有一天它們還是會瓦解。無 視其實是剝削。正因如此,這班印尼姐妹正在被剝削。但是,團結、堅持和勇氣為她們帶來了簡單卻最真實的快樂。這些快樂,是不會瓦解的。這種力量不僅為她們的群體帶來了支持,有幸見到的局外人都會被感染,被這種力量支持着。這班局外人甚至獲 得分享這種最真實快樂的資格。至於能否得到,就取決於這些人的決定了。

May Day March: Migrant Domestic Workers

Network of Indonesian Migrant Workers to Scrap Law No 39/2004(JBMI), an Indonesian domestic workers concern group, organized gathering and demonstration on International Labor Day to voice out their plight and to arouse public concern. In the morning, they sang, danced and had drama performance to raise the awareness of other Indonesian domestic workers on the rights they deserved, yet ignored and exploited. At noon, ATKI joined with other migrant’s organizations and marched to the Indonesian consulate with banners written “End slavery” and “We are workers. We are not slaves.” They expressed the dissatisfaction towards the ignorance, connivance to agencies and exploitative policies of both Hong Kong and Indonesian governments. After that, ATKI joined other local labor concern groups to march to the Central Government Office. Representatives of different groups, including the migrant workers, gave speech on behalf of different workers of long working hours and other labor concerns, to voice out their demands.

From the migrant workers, there are a total of six demands:

1. Increase the minimum wage of Migrant Domestic Workers (MDW)into HK$4,500 and include the them in the statuory minimum wage protection.
2. Repeal the Two-Week Rule (New Conditions of Stay) and other discriminatory visa policies on MDWs.
3. Make live-out an option and repeal the mandatory live-in employment arrangement.
4. Set the standard working hours for all workers in HK including MDWs.
5. Effectively address abusive and illegal practices of recruitment agencies.
6. Ratify the International Labour Organisation (ILO) Convention No. 189 on Domestic Workers that set human rights standards for the living and working condition of all domestic workers.

The root problem of the exploitations would be the disregards and policies of the two governments. The Indonesian government requires all labor workers to find jobs through agency companies and therefore, the unscrupulous companies exert every penny from the loopholes. They even get double paid by both employers and Indonesian workers. Also, the government demands every migrant worker to buy unreasonable insurance, of which its clauses only compensate injuries inside Indonesia, in order to exploit workers. In spite of regulations in Hong Kong, the SAR government does not help the situation with their loose enforcement, or to be precise, lacking in enforcement of the laws.

The interviewed Indonesian domestic workers believe the united power of the migrant sisters will bring hope to the exploitative situation they are facing. They have to speak out to protect themselves from the unreasonable and inhumane treatment. Even though recent news has revealed the violent treatment received by their sisters, they still want to deliver the message that “be nice to the employers” to their fellows as they believe there are good employers.

For Hong Kong people, these Indonesian migrant workers, first and foremost, want them to understand more about this anonymous group who also contribute for the prosperous economy of Hong Kong. What they want from the locals is just a fair treatment as human beings. They also emphasized that this treatment should not be just for them, but for all migrant workers regardless of where they came from.

A Canadian observer reckoned that exploitations do not just exist in Hong Kong, locals have responsibilities to understand workers in their workplace. On the other hand, the local government should take the responsibilities to ensure the various rights of the migrants workers, for example, the options of residence, the right to express, the right to complain and the right to be heard. The Indonesian government should, at the same time, reflect herself of the reason for the lacking of opportunities in the homeland. Also, the government should provide real choices, instead of forced choices, to her overseas workers.

Afterthoughts

Migrant domestic workers face different level of difficulties because of the difference in nationalities, identities and cultures etc. Being exploited by the policies of their own countries and their working countries, they are challenged, physically and mentally. As they are miles away from home, all they can choose is endurance. In the society, they are uncertain of their basic rights, let alone voicing their demands. They also lacks the courage to deal with the suppression inflicting on them, both internal and external. After the demonstration and interview, I found that what they wanted are actually very simple – to share, march and connect with the others; to be heard and respected by the people of Hong Kong, this is enough to give them laughters and contentment. In the material-rich Hong Kong, peoples have a lot of external luxury already, and yet are still pursuing a higher standard of living blindly. Nevertheless, peoples quality of living is diminishing, like forbearance, empathy and respect. Most of the peoples are so concerned of their short-term gains and forgotten about the basic humanity. What is worse, some may even discriminate the migrant domestic workers in various ways. I saw the true beauty of these sister when they still believe that not everyone would treat them badly even in such discriminating situations. They leave their own families, go into the others’ family and serving heartily. Do we really understand the bitterness and homesickness? Imagine one day when you work abroad, people treat you as slave instead of human, how would you feel? Back to the basics, we should put ourselves into others shoes and wipe our blind eyes, and take a good look at these tolling sisters and all the efforts they have given and rethink on the nondetachable relationship between us. They are part of our community, and without their contribution, how can we busy Hong Kong people leave behind our domestic chores

Many born-with-privilege people choose ignorance in order to continue living in the happy imagination. This happy imagination may not fall apart, or it may someday. Ignorance is exploitation. This is why the migrant workers are exploited. Yet, with the unity, persistence and courage, simple but real happiness in this community will not fall apart. Together, they fight for what they deserved. The perseverance does not only provide support inside the community, but also give support to outsiders to become insiders and enjoy the privilege of having real happiness. They provide another choice of happiness for those living-in-happy-imagination people. But for the type of happiness they want, they have to make their own choice.

【遊行:社會投資 全民受惠 稅制改革 拯救未來 】

政府在2月26日公布財政預算案,財政司表示香港面對人口老化帶來公共開支的增長會對未來構成沉重負擔,因此建議從2千多億的土地基金轉為一個「未來基金」,並將每年財政盈餘撥入未來基金,用作未來基建之用。但面對結構性貧富懸殊及傾斜房地產金融資本的不公義,普羅市民受著高房價、高租金、缺乏全民退休保障、醫療教育商品化、公共資產私有化等的煎熬。坐擁七千多億財政儲備的香港政府卻麻木不仁,拒絕將原屬於市民的社會資源進行財富再分配、亦否定香港進行稅制改革。因此,我們發起今次遊行,提出我們對於今年財政預算的不滿,要求政府改變其傾銷資本利益的財經政策,加強財富再分配的力度,讓我們有尊嚴地生活。我們呼籲各位市民積極參與是次行動。

被虐印傭ERWIANA回港作供 港警及印領事館挾走人證經過

Erwiana 及其父親,於4月7日抵達香港,但被迫住在駐港印尼領事館,受全日監控。協助Erwiana的移工服務團Mission for Migrant Workers(MFMW)成員Isabel,講述事情的經過。

曾有受虐外傭 變相軟禁領事館

Isabel說,Erwiana來港作供的住宿問題,早在她來港之前就出現爭拗。

Erwiana來港作供,香港警察原本應負責她的住宿和交通安排。但警察卻交予印尼領事館安排,要求Erwiana住在印尼領事館。這種安排並不是第一次,去年八月中揭發印尼家務工Kartika被禁錮,案件審理期間,Kartika也住在領事館,但直到現在仍被變相軟禁於領事館,每日只有一小時自由時間。

鑑於Kartika的遭遇,Erwiana不同意安排,委託MFMW另外安排住宿。MFMW在她到港前和警察、印尼領事館開會商討,但會議期間,警方堅持基於「安全理由」,要Erwiana待在領事館,又指若不住在領事館會撤回訴訟。

另外,Erwiana及她父親,由於早前求助不獲中介公司理會,對中介公司失去信任,不想由中介公司負責在港住宿和交通。印尼領事館原本承諾,提供的住宿與中介公司無關。但在Erwiana來港前,印尼外交部卻違背承諾,說Erwiana來港的住宿和交通,會「根據印尼法律」,由印尼方面的中介公司負責。

當事人及律師被挾走 支援人士被扣留

到4月7日,Erwiana等五人,包括她父親、印尼代表律師、早前在機場發現Erwiana的前印尼家務工Riyanti,及Indonesian Migrant Workers Association (ATKI)的前副主席Iweng,來到香港機場。可是入境處要求Erwiana、她父親和印尼代表律師走特別通道,而另外兩人則不許走特別通道。一離開機場,Erwiana、她父親及代表律師,立即被送上印尼領事館及香港警方的車。另外兩人則失去聯絡,不知是被入境署,還是警察拘禁在機場內,一度失去聯絡。香港警察說向她們表示,不能同車送她們,因為只預備了三人座位的車。MFMW的人一直嘗試用電話與Erwiana溝通,後來得知原來她們在往領事館途中,期間香港警察更恐嚇Erwiana,若果不住在印尼領事館,會被馬上送回印尼。Erwiana不斷強調自己已與MFMW聯絡,已有屬意的隨行律師,不會任用領使館要求她用的律師。在外面的MFMW成員亦堅持要進印尼領事館交涉 ,於是最後警察答應讓MFMW成員,進入印尼領事館交涉。

至於另外的兩人,即 Riyanti及Iweng則是自行坐車到領事館,要求見Erwiana,由於Erwiana堅持要兩人陪同,所以最後二人可以進領事館。可是,在晚飯時,只有Erwiana、她父親和印尼代表律師被帶去領事館內吃飯,這二人被丟在房間中。

今日的事件,暫時是Erwiana萬般無奈地暫住在領事館,並只是成功爭取到兩住朋友可以陪伴共住到她作供及離港。可是,有關律師的問題,仍未得到最終解決。在領事館內的遭遇,亦是未知之數。

團體怒斥官官相衛

昨日在緊急呼籲之下,有約六十人傍晚開始在領事館外聲援五位人士。[為Erwiana爭取公義及捍衛外傭權益委員會]發言人,現同為印尼家務工的Eni指,印尼政府想極力掩蓋事件,而香港政府卻積極配合,實為助紂為虐。現場香港市民亦有若二十多人,均表達對香港政府做法極之不滿。今天早上十時,[為Erwiana爭取公義及捍衛外傭權益委員會]仍呼籲在印尼領事館外聲援在內的五位人士。

Erwiana 及其父已被安排於 2014年4月7日乘搭嘉魯達印尼航空 GA860 班機抵達香港。Erwiana 今次來港,本是應香港警察邀請來港進行身體檢查,為控訴其前僱主羅雲東的案件提供證據。

早於今次安排之前,Erwiana 已有需來港作證的打算,並已委託香港的移工服務團 (Mission for Migrant Workers – MFMW) 在需要時為她及這段時間內為她提供協助的團隊提供在香港的食宿及其他協助。而協助她的團隊包括,來自日惹的法律援助律帥 Samsudin Nurseha、曾協助她回家的 Rianti、及印尼移工聯網的代表 Karsiwen。

然而,今次印尼政府卻單方面地安排了 Erwiana 及其父親在抵港後需入住,二十四小皆被監控的,駐港印尼領事館大樓之內。另外,關於協助 Erwiana 的團隊的三位朋友,現時仍未有明確安排,未知是否可繼續陪伴及協助 Erwiana。在得知被邀來港後,Erwiana 已多次詢問何時可取得來港機票及行程安排,卻一路未獲印尼政府回覆。直至今天 (星期日),駐港印尼領事館的職員突然去到 Erwiana 的家中把他們接送到梭羅,入住機場附近的 Ibis 酒店。隨即,印尼外交部的官員立刻來到酒店,並提出為 Erwiana 安排律師。當 Erwiana 回應已經由移工服務團安排了代表律帥 Mr. Melville Boase 後,該官員竟無端指控移工服務團的安排別有用心。並施壓要求 Erwiana 簽署文件把案件交由印尼政府處理。就此,Erwiana 已拒絕了要求。但住宿安排方面,Erwiana 仍然被安排需入住 駐港印尼領事館大樓之內。Erwiana 提出入住移工服務團為她所安排的住所的要求仍被拒絕。

Erwiana 才剛逃離她前僱主的困籠,卻又需被監控於領事館之內。請並不是為她提供協助,而是對她進行壓制。

印尼領事館未能保護 Erwiana 免受其僱主的虐待,亦未能為審訊提供所需的文件而導致審訊被迫延期至2014年4月29日。印尼領事館之前並未為 Erwiana 的案件出力,為何現時又突然投入及主導呢?領事館只是嘗試制約 Erwiana 的自由選擇權利去掩蓋它的過失及問題。Erwiana 應有權委托她所信任的團隊,而非不道德的領事館操弄。

Erwiana dan Bapaknya dijadwalkan tiba di Hong Kong pada hari Senin, 7 April 2014, dengan pesawat Garuda Indonesia GA 860. Kepolisian HK mendatangkannya dalam rangka  medical check-up guna memperkuat bukti di pengadilan melawan majikan Law Wan Tung. Erwiana juga akan didampingi Samsudin Nurseha Pengacara LBH-Yogyakarta, Rianti yang menolongnya waktu dipulangkan majikan dan Karsiwen anggota JBMI-Indonesia. Sejak tahu akan ke Hong Kong, Erwiana telah meminta Mission for Migrant Workers (MFMW) untuk menyediakan akomodasi dan mendampingi selama di Hong Kong. Namun kini secara sepihak, Erwiana dan bapaknya diharuskan tinggal di gedung konsulat dengan pengawalan 24 jam. Bahkan masih belum ada kejelasan apakah ketiga pendampingnya akan diijinkan tinggal bersama. Lebih dari itu, tiket Erwiana tidak diberikan sejak awal meski sudah ditanyakan berkali-kali. Baru hari ini (Minggu) staff KJRI-HK datang ke Ngawi untuk memberi  tiket dan sekaligus menjemput mereka berdua untuk dibawa ke Solo. Mereka diinapkan di Hotel dengan alasan lebih dekat dengan bandara. Awalnya Erwiana menolak karena sudah berencana berangkat dini hari bersama rombongan. Tapi team KJRI ini mengancam tidak akan bertanggungjawab jika terjadi apa-apa. Demi membantu penyidikan, Erwiana berangkat tapi para pendampingnya diikutsertakan. Tapi tidak lama kemudian ternyata petugas dari Kementerian Luar Negeri datang ke Hotel Ibis dan menawari Pengacara untuk Erwiana. Ketika dijawab menunjuk Mr. Melville Boase sebagai pengacaranya, petugas tersebut malah menuduh MFMW macam-macam. Dia juga menekan Erwiana untuk bertanda tangan surat yang menyatakan akan melimpahkan kasusnya ke pemerintah Indonesia. Tapi Erwiana menolak. Terkait akomodasi, Erwiana dan Bapak tetap diharuskan tinggal di gedung KJRI dengan alasan mereka warga Negara Indonesia. Permintaan Erwiana untuk tinggal di rumah yang disediakan MFMW juga ditolak.

Erwiana baru saja keluar dari penjara majikan dan kini akan di penjara KJRI. Sikap tersebut tidak menunjukan sebuah dukungan tapi pemaksaan.

KJRI gagal melindungi Erwiana dari siksaan majikan dan  gagal menyediakan dokumen yang dibutuhkan Polisi sehingga persidangan Erwiana terpaksa ditunda 29 April 2014. Kini KJRI akan menumbalkan kebebasan dan hak Erwiana untuk memilih demi menutupi kesalahannya sendiri. Dari awalpun bukan KJRI yang memperjuangkan kasus Erwiana, mengapa kini ingin mengambil paksa? Erwiana berhak menunjuk siapapun yang dia percaya dan tidak etis KJRI memaksa. ###

“Coming on the heels of Erwiana’s case, the Hong Kong government is desperately trying to cover up the serious flaws on its policies on foreign domestic workers (FDWs) by lying and creating the phantom problem of job-hopping among FDWs.”
『緊隨著因 Erwiana 的個案而曝光而顯露的狀況,香港政府急忙地製造外藉家務工「跳工」的論述,藉以掩蓋其政策中的嚴重問題。』

This was the reaction of the Asian Migrants Coordinating Body (AMCB-IMA) as their members picketed the Immigration Department today to denounce the Security Bureau’s claims of job-hopping among FDWs to collect severance payment and money for airfare.
亞洲移居人士聯盟成員就保安局所提出,外藉家務工藉「跳工」以騙取遣散費及機票費用的指控,今天於入境處進行抗議行動。以上就是亞洲移居人士聯盟就這指控的回應。

“Job-hopping among FDWs for reason the government says and for the bases they claim is highly-improbable if not bordering on a total lie. First of all, an FDW cannot collect severance payment if they worked for less than 12 months. Secondly, the so-called financial gains after termination including the one-month salary in lieu of notice as well as the airfare are not even enough to cover even half of what the agencies charge us. There is no rational or practical reason for an FDW to job-hop,” said Dolores Balladares, spokesperson of the AMCB-IMA.
亞洲移居人士聯盟發言人 Dolores Balladares 說『政府對外藉家務工的「跳工」指控以及其聲稱的原因,即使不是完完全全的謊言,亦是一個極不可能發生的情況。首先,一個外藉家務工在工作滿十二個月前,根本不會獲發遣散費。再者,終止合約後所獲發的代通知金及機票費用,加起來亦未足夠支付中介公司收取我們的費用的一半。理性上及現實上,外藉家務工都沒有理由要「跳工」。』

The group also questioned the legitimacy of using the data the Secretary for Security Lai Tung-Kwok relayed to the public to show the so-called job-hopping practice of FDWs.
聯盟同時質疑保安局局長黎棟國,挪用來向公眾論證外藉家務工「跳工」的數據。

“We should note that the 1,372 applications are only suspected job-hoppers based on unreasonable and arbitrary criteria. Of this, 170 were rejected based on unproven allegation of job-hopping to collect payment. The 158 who voluntarily withdrew their application cannot also be conclusively classified as job-hoppers. The Security Bureau is not even making a mountain out of a molehill but actually creating an issue where none exists at all,” Balladares added.
Balladares 補充說:『我們需注意到,那1,372個懷疑個案,全都只是基於一些不合理及隨意理由的懷疑個案。當中,保安局只正式拒絕了170個個案, 而這些還都只是未經證實的懷疑「跳工」個案。另外158個自行徹回的申請更不可能被定性為「跳工」。保安局不單只小事化大,簡直就是無中生有。』

The release of these dubious data, Balladares remarked, is highly-suspect given that the topic is being drummed up by the government and political parties known for their anti-migrant stands in the middle of national and international calls to review the Hong Kong policies of Hong Kong that expose FDWs to different forms and degrees of abuses like what happened to Erwiana.
Balladares 更提到『在香港以至國際社會都因 Erwiana 的個案而注意到,香港的有關政策把外藉家務工曝露於一個易受侵犯的困境,而發出聲音要求正視及改善的情況下,香港政府在眾所周知對移民持反對態度的政客提問下,發放這些似是而非的數據的目的十分可疑‧』

“They want to project that we are abusing the system whereas the truth is, this system has failed Erwiana and all FDWs in protecting our rights and wellbeing. The Two-Week Rule, mandatory live-in employment arrangement and other exclusionary policies of Hong Kong have made what happened to Erwiana possible. The truth is that HK policies are seriously flawed and have in need of immediate and comprehensive changes,” Balladares declared.
Balladares 指出『它們企圖抹黑我們在捐害既有機制,但實情是,這機制根本不能保障外藉家務工的權益。Erwiana 的個案可見,這機制完全失效。兩星期逗留條件、強制留宿的僱用安排、以至其他的社會性排斥措施,在在容讓如 Eriwana 的情況發生。實情是,香港的有關政策存在著極為嚴重的問題,亟需立即作出實質的改變。』

The AMCB-IMA implored the Hong Kong government to stop “diverting the issue and creating a baseless public scare” and instead look into the demands for review of policies on FDWs.
亞洲移居人士聯盟強烈要求香港政府停止轉移視線,揑造無根據的指控製造公眾恐慌,正視各方要求檢視有關外藉家務工的政策措施的要求。

“They should just stop the lies and the scare-mongering. The malicious claims of job-hopping and making it appear that FDWs are engaged in a criminal act – though there’s no law against job-hopping in Hong Kong – are unjust and make Erwiana and all FDWs victims twice over of a system that abuses and enslaves migrant workers,” Balladares concluded.#
Balladares 總結說『它們應停止謊言推搪及製造恐慌。「跳工」的惡毒指控,把外藉家務工抹黑成一群不法勾當之徒,然而香港並沒有法例不容許轉工。這樣的作法實在極不公義,更是在這制度下,對 Erwiana 以至所有的外藉家務工的再一次打壓及侵犯。』

印尼家務工手指遭僱主斬斷

Violence on FDWs to continue if no major policy reforms happens
如無重要制度性改革,對外藉家務工的暴力侵害將繈續發生

“The violence towards foreign domestic workers (FDWs) in Hong Kong will continue as long as the Hong Kong government insist on its flawed and anti-migrant policies that promote modern-day slavery.”
如香港政府繼續堅持它極之有問題及壓制著移民工的政策的話,對在香港的外藉家務工的奴役狀況及暴力侵害將繈續發生。

This is the response of Sringatin, spokesperson of the Asian Migrants’ Coordinating Body (AMCB) and the Justice for Erwiana and All Migrant Domestic Workers Committee (J4EMDW), to the latest incident of violence committed against a newly-arrived Indonesian domestic worker.
「亞洲移居人士聯盟」及「為 Erwiana 及所有移民家務工爭取公義委員會」的發言人Sringatin, 對剛剛發生在一位來港不久的印尼家務工的暴力事件作出以上回應。

Anis Adriani, a 28-year old domestic worker from East Java in Indonesia was brought to the hospital last Monday, 24 February, after her employer chopped-off her finger with a kitchen knife.
Anis Adriani 是一位來自印尼東爪哇,28歲的家務工。上星期一,二月二十四日,她被他的僱主用廚刀斬脫了她的手指後,被送往醫院救治。

“We are outraged. How can someone do this to a fellow human being? This is another example of the ugly face of violence and modern-day slavery of FDWs in Hong Kong,” said Sringatin.
Sringatin 說『我們極之憤怒。怎麼可有人對另外一個人做出這樣的事情?這是在香港的外藉家務工所面對的暴力對待及奴役狀況的又一次例證。』

According to Sringatin who visited Anis several times since she was hospitalized, the incident happened in the morning of 24th February after her male employer and 17-year old ward left the house. Anis’ female employer was still sleeping when their dog started to bark loudly. She (Anis) tried calming the dog but it just kept barking until the female employer of Anis woke up.
Sringatin 在 Anis 住院後已探望了她好幾次,據她所說,事發在二月二十四日的早上,在 Anis 的男僱主跟 17 歲的女兒出門後,她的女僱主仍在睡覺時他們養的狗開始大聲的吠叫。Anis 嘗試讓它安靜下來,但它只顧繼續吠叫,直至女僱主醒來仍在吠。

To the surprise of Anis, her employer spoke something, which she couldn’t understand and then pulled her by her hand to the kitchen, placed it on a chopping board and then chopped her finger with a kitchen knife. The female employer left her bleeding as if nothing had happened.
Anis 也被嚇到,她的顧主在跟她說了一句她聽不明白的說話後,執著她的手把她拉進廚房,把她的手放上枮板,拿起廚刀斬落她的手指。跟著女僱主就若無其事地逕自離開,由得 Anis 在那裡流血。

Anis tried to seek help from a fellow Indonesian working for their neighbor who advised her to call the employment agency. The staff at the agency told Anis to wait inside the house and soon, two personnel from the ambulance services came with the building security. She was brought to the hospital afterwards.
跟著,Anis 嘗試向一位在隔壁工作的印尼朋友尋求幫助,那位印尼朋友就叫Anis 聯絡 Anis 自己的中介公司。中介公司的職員叫 Anis 留在屋內等候。不久,兩位救護員跟大廈的保安員來到,並把她帶回醫院。

“The problem is, as long as the government keeps on defending its flawed and discriminatory policies like the two-week rule, mandatory live-in, and now, this arbitrary denial of visa to FDWs being suspected of “job-hopping”, the prevailing culture of treating FDWs as slaves will continue and incidents of violence committed against our fellow migrant workers will persist,” Sringatin averred.
Sringatin 強調說『問題是,只要政府繼續堅持它那些極有問題及帶歧視性的政策措施,現時極為普遍的,奴役外藉家務工及對她們暴力侵害的個案,將繼續發生。那些政策措 施包括,兩星期逗留條件、強制在僱主家中留宿、以至最近因被懷疑「跳工」而被拒絕簽證申請的個案,等等。』

“Instead of defending, the Hong Kong government should make a move to repeal and reform anti-migrant policies as it will surely send a clear message to unscrupulous employers that FDWs must be treated with respect. Until then, abuse of FDWs like what happened to Erwiana, and now with Anis, will always be a common occurrence in Hong Kong,” Sringatin said.
Sringatin 續說,『與其扥詞推搪,香港政府更應該明確地啟動對移民工不利的措施的改革及修正。因這可向那些肆無忌憚的無良僱主發出一個必須尊重外藉家務工的訊息。』

“We are now in constant communication with Anis. We heard that the police have arrested the employer. We are discussing with her other actions that can be taken so she can get comprehensive justice,” Sringatin concluded.
Sringatin 總結說『我們現在正跟 Anis 保持著連繫。我們聽說警方已拘捕了那僱主。我們將跟她討論可為她取回公義的跟進行動。』

超收中介費系列之二: 有關中介公司收費的疑點
